Andy Ogles — U.S. Representative (TN-5)

Category: Federal Legislator — U.S. Representative Role: U.S. Representative, Tennessee’s 5th Congressional District (2023–present); former Mayor of Maury County, Tennessee (2018–2022) Priority: P1 (pattern of conduct materially advancing democratic erosion — a constitutional-amendment vehicle for a third Trump term, serial impeachment filings against federal judges who ruled against the administration, and the use of a congressional office to press DOJ to denaturalize a political opponent; separately documented campaign-finance fraud exposure with federal search warrants executed against him)

Basis for Inclusion

Subject Classification: Public Official — serving U.S. Representative (lame-duck; defeated in the August 6, 2026 Republican primary)

Basis for Inclusion: (1) Publicly endorsed the Pentagon’s planned December 3, 2026 livestreamed firing-squad execution of Nidal Hasan, calling it “excellent” when the proposal drew bipartisan congressional, UN, and Catholic-leadership condemnation; (2) introduced a House Joint Resolution to amend the 22nd Amendment to allow a president who has served two non-consecutive terms — a description matching only Donald Trump — to seek a third term; (3) filed articles of impeachment against three sitting federal judges (Bates, Chuang, and joined on Boasberg) specifically because they ruled against the Trump administration; (4) used his official office to press the Attorney General to denaturalize and deport 2025 New York City mayoral candidate Zohran Mamdani over constitutionally protected speech; (5) was the subject of FBI search warrants executed on his person, home, and email account, an Office of Congressional Ethics referral finding “substantial reason to believe” he violated campaign-finance law, and an open House Ethics Committee investigation.

What Is Not the Basis for Inclusion: General conservative policy positions, party affiliation, or the underlying Fort Hood case against Nidal Hasan, who was convicted by court-martial of murdering 13 people in 2009 — a matter independent of Ogles’s conduct.

Who Is Andy Ogles?

William Andrew Ogles IV (born June 18, 1971) is a Republican who has represented Tennessee’s 5th Congressional District since January 2023. He previously served as Mayor of Maury County, Tennessee (2018–2022) and as executive director of the Tennessee chapter of Americans for Prosperity (2013–2018). He attended a “Stop the Steal” rally in Nashville on November 7, 2020, and has promoted the false claim that the 2020 election was stolen.

NewsChannel 5 (Nashville) reported in February 2023 that Ogles had exaggerated or fabricated multiple elements of his personal and professional biography after taking office, including claims to be a trained economist, a nationally recognized tax-policy expert, a former police officer, and an expert in international sex crimes. His college transcript, later obtained by the station, showed a general degree in Liberal Studies rather than the International Relations degree he had claimed, with a single economics course completed for a “C” grade. His congressional biography’s claim that he “studied policy and economics” at Middle Tennessee State University was contradicted by a 2009 resume listing a degree in International Relations with minors in psychology and English.

Ogles lost the Republican primary for TN-5 to former Tennessee Agriculture Commissioner Charlie Hatcher on August 6, 2026, despite a Trump endorsement, after redistricting split his base; his term ends January 3, 2027.

Documented Actions

1. Public endorsement of a livestreamed military execution (October 2026)

Nidal Hasan — convicted of killing 13 people in the 2009 Fort Hood shooting — would be executed by firing squad on December 3, 2026, and that the execution would be livestreamed to the public, the first U.S. military execution since 1961 and the first public one in nearly a century. The proposal drew condemnation from the United Nations, Catholic Church leaders, and lawmakers from both parties, including Republican Sens. Lisa Murkowski and Thom Tillis and Rep. Austin Scott, who warned it risked making Hasan a martyr and that “live-streaming executions is what jihadists do.” Ogles posted on X: “Excellent. Public execution is what this terrorist deserves. We will be watching.” DHS Secretary Markwayne Mullin separately defended the plan on CBS’s “Face the Nation,” telling host Margaret Brennan “no one has to watch it” when asked about radicalization risk.

Pattern: Endorsement of state spectacle violence as a loyalty signal to the administration, over the objection of members of his own party.

2. Resolution to amend the 22nd Amendment to allow Trump a third term (January 2025)

SourceRep. Ogles press release, “Rep. Ogles Proposes Amending the 22nd Amendment to Allow Trump to Serve a Third Term,” ogles.house.gov, January 23, 2025, http://ogles.house.gov/media/press-releases/rep-ogles-proposes-amending-22nd-amendment-allow-trump-serve-third-term; Denver Gazette, “Ogles introduces resolution to allow Trump to seek third term,” January 24, 2025, https://www.denvergazette.com/2025/01/24/ogles-introduces-resolution-to-allow-trump-to-seek-third-term-9888e048-584b-5baa-846a-36bbc12d77c9; Wikipedia, “Donald Trump third term proposal” (cross-checked against the above primary sources), https://en.wikipedia.org/wiki/Donald_Trump_third_term_proposal.Evidence: On January 23, 2025 — three days into Trump’s second administration — Ogles introduced H.R. 361’s companion constitutional vehicle, a House Joint Resolution to amend the 22nd Amendment to allow a president who has served two non-consecutive terms to be elected to a third. Because Trump is the only living president to have served two non-consecutive terms, the amendment as drafted would not have benefited any other living former president (Clinton, Bush, or Obama). Ogles’s press release stated that Trump’s “decisive leadership” made him “the only figure in modern history capable” of a third term. Conservative groups including the Third Term Project promoted the resolution at CPAC 2025.

Pattern: Legislative vehicle for extending a single executive’s tenure beyond constitutional term limits.

3. Serial articles of impeachment against federal judges who ruled against the Trump administration (February–March 2025)

SourceNew York City Bar Association, “Statement Condemning Threats to Impeach Federal Judges Based on Disagreement with Rulings,” https://www.nycbar.org/press-releases/statement-condemning-threats-to-impeach-federal-judges-based-on-disagreement-with-rulings; The Hill, “Republicans target two judges for impeachment,” https://thehill.com/homenews/house/5213176-trump-administration-judges-impeachment; Courthouse News Service, “Republican lawmakers resurrect impeachment of DC Fed Judge Boasberg,” https://www.courthousenews.com/republican-lawmakers-resurrect-impeachment-of-dc-fed-judge-boasberg; The Center Square, “Republicans slap articles of impeachment on more federal [judges],” https://www.thecentersquare.com/national/article_4d864181-e732-4a47-b3e7-556de5808567.html.Evidence: On February 24, 2025, after U.S. District Judge John D. Bates ruled against the Trump administration in a case over removing “gender ideology” content from federal health websites, Ogles introduced a resolution to impeach Bates, alleging his ruling reflected a lack of “intellectual honesty and basic integrity” constituting “high crimes and misdemeanors.” On March 24, 2025, after U.S. District Judge Theodore D. Chuang ruled against the administration in a national-security-related case, Ogles introduced a resolution alleging Chuang had “marginalized the President’s Article II authority” and was “guilty of high crimes and misdemeanors.” Ogles also joined Rep. Andrew Clyde in filing articles of impeachment against D.C. federal Judge James Boasberg after Boasberg temporarily blocked the administration’s mass deportation of Venezuelan migrants. The New York City Bar Association issued a statement condemning the pattern of impeachment threats against judges “based on disagreement with rulings.”

Pattern: Weaponizing the impeachment power against Article III judges for adverse rulings rather than documented misconduct — an attack on judicial independence as a check on the executive.

4. Campaign to denaturalize and deport a political rival over protected speech (June–October 2025)

SourceOgles press release, “Ogles Leads Charge to Denaturalize and Deport Zohran Mamdani,” ogles.house.gov, October 29, 2025, http://ogles.house.gov/media/press-releases/ogles-leads-charge-denaturalize-and-deport-zohran-mamdani; Al Jazeera, “Republicans push to strip Zohran Mamdani of US citizenship. Is it possible?,” November 9, 2025, https://www.aljazeera.com/news/2025/11/9/republicans-push-to-strip-zohran-mamdani-of-us-citizenship-is-it-possible; NBC News, “Calls to strip Zohran Mamdani’s citizenship spark alarm about Trump weaponizing denaturalization,” https://www.nbcnews.com/politics/donald-trump/calls-strip-zohran-mamdanis-citizenship-trump-denaturalization-power-rcna216653; Poynter/PolitiFact, “Why efforts to revoke Zohran Mamdani’s US citizenship are unlikely to succeed,” https://www.poynter.org/fact-checking/2025/zohran-mamdani-citizenship-revocation-claims.Evidence: On June 26, 2025, Ogles sent a letter to Attorney General Pam Bondi requesting that DOJ pursue denaturalization proceedings against Zohran Mamdani — then the Democratic nominee for New York City mayor — “on the grounds that he may have procured U.S. citizenship through willful misrepresentation or concealment of material support for terrorism.” The stated basis was rap lyrics Mamdani wrote in 2017 expressing support for the “Holy Land Five,” men convicted in 2008 of providing material support to Hamas; immigration lawyers and fact-checkers (PolitiFact, NBC News) characterized the legal theory as unlikely to succeed and the underlying conduct as constitutionally protected speech predating naturalization. On October 29, 2025, Ogles’s office issued a press release — “Ogles Leads Charge to Denaturalize and Deport Zohran Mamdani” — renewing the request after Mamdani won the mayoral election.

Pattern: Using congressional office and federal law enforcement to target an elected political opponent over protected political speech.

5. Islamophobic public statements and legislation targeting Muslim immigration (March 2026)

SourceNPR, “Tennessee GOP Rep says Muslims ‘don’t belong in American society,'” March 9, 2026, https://www.npr.org/2026/03/09/g-s1-113033/tennessee-gop-rep-says-muslims-dont-belong-in-american-society; Politico, “Tennessee GOP Rep. Andy Ogles says Muslims ‘don’t belong’ in America,” March 9, 2026, https://www.politico.com/live-updates/2026/03/09/congress/andy-ogles-muslim-americans-ban-00818765; congress.gov, H.Res.1113, 119th Congress, https://www.congress.gov/bill/119th-congress/house-resolution/1113; Time, “Anti-Muslim Congressman Has Thousands of Muslims in His District,” March 11, 2026, https://time.com/article/2026/03/11/andy-ogles-says-muslims-don-t-belong-in-america-thousands-live-in-his-district.Evidence: On March 9, 2026, Ogles posted on X: “Muslims don’t belong in American society. Pluralism is a lie,” followed by additional posts stating “America is a product of English Christian culture,” that Muslims should live in one of the “57 Islamic countries,” and calling for deportation of naturalized Muslim Americans. Days earlier, his office had announced plans for legislation to ban immigration from a set of Muslim-majority nations, framed as an extension of Trump’s 2017 travel restrictions. Rep. Shri Thanedar introduced H.Res.1113 on March 12, 2026, to censure Ogles and remove him from the House Homeland Security Committee; it was referred to the House Committee on Ethics. The Freedom From Religion Foundation separately called for his resignation.

Pattern: Official-capacity bigotry paired with a legislative vehicle, not an isolated remark.

6. Federal campaign-finance investigation, FBI search warrants, and House Ethics referral (2022–2026)

Evidence: Ogles’s 2022 campaign finance reports claimed he personally loaned his campaign $320,000; he later admitted that figure was false and amended it to $20,000. The Campaign Legal Center filed a complaint with the Office of Congressional Ethics (OCE) on January 9, 2024, citing over $1 million in financial-disclosure discrepancies. The OCE referred the matter to the House Committee on Ethics on August 2, 2024, finding “substantial reason to believe” Ogles’s campaign committee “accepted excessive contributions reported as personal loans” and that he “omitted or misrepresented required information” in disclosures; the Committee announced on January 2, 2025 that it would continue its review and has not closed it as of this writing. Separately, the FBI obtained a search warrant for Ogles’s personal Google account (July 2024) and, the day after his August 2024 primary win, executed a search warrant seizing his personal cell phone. Ogles’s legal team fought DOJ’s access to the seized material on Speech-and-Debate-Clause separation-of-powers grounds; career Nashville prosecutors withdrew from the case in January 2025 after Trump’s inauguration, and in May 2026 the Trump DOJ agreed to return or destroy the seized evidence before the FBI reviewed it, effectively ending the criminal investigation without charges. A federal magistrate had sat on the return-of-property motions for more than 14 months without ruling before resigning from the bench. Unsealed FBI affidavits (filed by Special Agent Brent Hayden) stated investigators had probable cause to believe Ogles violated federal laws against false statements, falsification of records, and conspiracy; the names of alleged co-conspirators remain redacted.

Crenshaw Jr. and U.S. Magistrate Judges Alistair E. Newbern and Luke A. Evans.

Pattern: Documented federal investigation into campaign-finance fraud, resolved via a separation-of-powers litigation strategy and a change in DOJ leadership rather than a finding on the merits; House Ethics review remains open.

Additional pattern notes — personal credibility

Andy Ogles deletes homophobic social media post, blames staffer,” https://www.nbcnews.com/politics/congress/gop-rep-andy-ogles-deletes-homophobic-social-media-post-blames-staffer-rcna348227.NewsChannel 5’s investigative reporting (2023–2026) separately documented that Ogles’s congressional biography and public statements misrepresented his academic credentials (claiming an International Relations degree and graduate coursework at Vanderbilt and Dartmouth; his actual transcript showed a general Liberal Studies degree), his professional background (claiming to be a “nationally recognized” economist and a trained police officer), and his connection to economist Arthur Laffer (an administrative role at the Laffer Center, not an economist position). In June 2026, Ogles deleted a post from his official congressional X account reading “Homosexuality has no place in America. Happy Nuclear Family Month,” blaming an unnamed staffer. These are documented pattern elements bearing on credibility; they are not separately scored for democratic-erosion severity.

Democratic Malice Assessment

Designation: Pattern of conduct consistent with enabling authoritarian consolidation — not independently scored as a DMS criminal-conduct designation, since no court or congressional finding of guilt exists as of this writing.

Ideology vs. Malice determination: Malice. Several of Ogles’s actions were exercised through ordinary (if extreme) legislative channels — introducing resolutions and bills is protected legislative activity regardless of content. What elevates this profile beyond an ideology-disagreement case is the target of that activity: a constitutional-amendment vehicle whose only living beneficiary is the sitting president; impeachment filings against judges explicitly premised on adverse rulings rather than misconduct; and the use of congressional letterhead to press DOJ to strip citizenship from a successful political opponent over pre-citizenship speech. Each of these targets a check on executive power (term limits, judicial independence, electoral competition) rather than a policy outcome — the pattern the Democratic Malice framework treats as subversion of democratic mechanisms rather than ordinary political conduct.

Framework disclosure: This assessment applies a published analytical framework to documented public actions by a public official. All factual predicates are cited to primary sources (press releases, congress.gov, CourtListener dockets) or named reporting. This assessment is subject to update as new evidence emerges or prior evidence is corrected.

Legal Disclaimer

The Democratic Malice Assessment is an analytical framework applying defined criteria to documented public conduct. Designations are evaluative conclusions, not statements of criminal guilt. No DMS score constitutes a finding of criminal liability. The factual predicates are cited to primary sources; the evaluative conclusions are protected expression. New York Times Co. v. Sullivan and its progeny apply to this assessment of a public figure’s public conduct.

Accountability Status

Current status: Active — serving as U.S. Representative (TN-5), lame-duck; defeated by Charlie Hatcher in the August 6, 2026 Republican primary; term ends January 3, 2027.

Legal exposure:

  • 18 U.S.C. § 1001 (false statements) and 52 U.S.C. § 30104/30109 (FEC reporting violations) — the theory named in the unsealed FBI search-warrant affidavit (false statements, falsification of records, conspiracy regarding the $320,000 campaign-loan claim); DOJ agreed in May 2026 to return/destroy seized evidence rather than pursue charges, but no court has ruled on the merits and the House Ethics Committee’s parallel review (which can proceed independent of DOJ’s charging decision) remains open.
  • House Rule XXIII / standards of conduct — the basis of the OCE referral and ongoing Committee on Ethics review.

Congressional oversight:

  • House Committee on Ethics — open review of the OCE referral (OCE Rev. No. 24-3057) regarding financial-disclosure and FEC-reporting conduct.

Public accountability:

  • Campaign Legal Center — filed the original OCE complaint and continues to track the matter.
  • Reporters Committee for Freedom of the Press — litigated and won unsealing of the search-warrant affidavits on behalf of NewsChannel 5/Scripps Media.
  • NewsChannel 5 Investigates (Phil Williams) — ongoing investigative coverage since 2023.
  • Rep. Shri Thanedar — introduced H.Res.1113 (119th Congress) to censure Ogles and remove him from the House Homeland Security Committee over the Islamophobic statements; referred to the House Committee on Ethics.

Truth and Reconciliation Considerations

Investigation priorities

  1. What communications, if any, occurred between Ogles’s office, the White House, and DOJ leadership regarding the May 2026 decision to return/destroy evidence seized in the campaign-finance investigation, and whether that decision reflected the merits of the case or political considerations.
  2. Whether Ogles’s June 2025 and October 2025 letters to Attorney General Bondi regarding Zohran Mamdani were coordinated with other House Republicans, the White House, or DHS, and what DOJ’s internal response to the denaturalization request was.
  3. The full, unredacted content of the FBI search-warrant affidavits (Nos. 3:24-mj-04250, 3:24-mj-04276), including the identity of redacted “co-conspirators,” and why U.S. Magistrate Judge Alistair Newbern did not rule on the return-of-property motions for more than 14 months before leaving the bench.
  4. Whether the timing and content of Ogles’s third-term resolution and Greenland-acquisition bill reflect a documented pattern of introducing symbolic legislation to curry favor with the administration while under active federal investigation.
  5. The full record of internal House Republican leadership deliberations, if any, regarding whether to act on the OCE referral or the Thanedar censure resolution.

Testimony value

Compelled testimony from Ogles (under use immunity, 18 U.S.C. § 6002) could clarify: (1) the factual basis for the $320,000 campaign-loan claim and who else was involved in preparing the FEC filings naming Lee Beaman as treasurer; (2) whether the decision to pursue judicial impeachment articles against Bates, Chuang, and Boasberg was coordinated with House leadership or the White House Counsel’s office; and (3) the internal deliberation behind the Mamdani denaturalization letters, including whether DOJ officials signaled receptiveness before the letters were sent.

Institutional reform

  • Statutory reform: Strengthen 52 U.S.C. § 30109 enforcement timelines so FEC referrals and OCE findings of “substantial reason to believe” trigger mandatory public disclosure deadlines, closing the multi-year gap that let this matter remain unresolved across two administrations.
  • New legislation: Prohibit members of Congress from using official letterhead or committee resources to request denaturalization or deportation proceedings against named political opponents absent a specific, non-speech statutory predicate.
  • Oversight mechanisms: Require House Ethics Committee reviews tied to an OCE “substantial reason to believe” finding to reach a public disposition (clearance, reprimand, or referral) within a fixed statutory period rather than remaining open indefinitely, including past a member’s departure from Congress.
  • Judicial independence protections: Codify that impeachment resolutions against Article III judges premised solely on the substance of a ruling (absent an allegation of corruption, bribery, or comparable misconduct) are out of order, consistent with existing House Rules precedent on frivolous impeachment filings.
